Seoul Central District Court finds Intematix and GVP infringe
Mitsubishi’s red phosphor patent
Mitsubishi Chemical Corporation
In the patent lawsuit in Korea at the Seoul Central District Court which Mitsubishi Chemical Corporation ("MCC") filed against a US company, Intematix Corporation ("Intematix") and a Korean distributor, GVP, claiming that they infringe a red phosphor patent in Korea (No. 816693) which is owned by MCC and National Institute of Material Science, the court ruled on February 5, 2013 that Intematix and GVP are enjoined from importing and selling their accused phosphor products, accepting our claims.

The Korean patent No. 816693 (*) relates to a nitride-type red phosphor commonly known as CASN and SCASN (**), and LED, lighting equipment and image display etc. in which such phosphor is used. CASN and SCASN is the red phosphor to be most widely used in LED due to its high brightness and reliability. Such red phosphor MCC now sells is supported and held in high repute by many LED manufacturers.

・This patent covers a wide range of CASN and SCASN phosphor and thus, for example, a CASN or SCASN phosphor containing one or more elements other than its main constituent elements may be within the scope of that patent.
・As to CASN and SCASN phosphor, MCC owns many relevant patents other than the above patent.

Should a party infringe any of MCC’s patents, we will take every appropriate measure without overlooking it.

Text of the Judgment



(English Translation)
1. The Defendants shall not import, sell, and offer to sell products set forth in the annex, and shall do dispose of products set forth in the annex that are kept in their offices, sheds and sales branches.
2. The litigation costs shall be borne by the Defendants.
